Are we finally seeing independence of the judiciary

by ParisB on May 11, 2009

Or is this just so we THINK there is independence of the judiciary?

The latest High Court decision that Nizar is the rightful Menteri Besar of the embattled Perak state may lead most to believe that there is a separation of powers between the legislature and judiciary. That all the allegations of interference are unfounded.

Well, there are 2 more rounds to go and Zambry has already said that he is going to lodge an appeal to the Court of Appeal. There waits the appointed judges who might very well turn this High Court decision on its head, rap the knuckles of the judge who so boldly went against the government of the day and installing the new rightful MB.

Or they might not and it might be Nizar all the way.

What then for Perak? Do they sit around for the next couple of months pondering the fate of their Chief of State and wondering who he might be? Do government departments now remove the freshly printed photos of Zambry to replace them with Nizar? What do the schoolkids in Perak learn? That it is ok to take control of government by force as they saw in the state assembly last week?

Or might this be the “ladder” for the BN to come down after the fiasco that turned Perak into little Taiwan last week? Might everyone NOW see some sense and return the power to the people of Perak to decide once and for all who they want in the State Government – BN or PR?

I’m watching and waiting but I’m not yet rejoicing.

I’m just surprised by the speed of the appeal. Wah, sometime our Court of Appeal can be quite efficient, kan?

But anyway, I’m sure I’m not saying anything new in that this one high court decision hasn’t really impressed most people, since the ‘rot’ has been happening over decades. One little case isn’t going to change that overnight.

So if the CA rules for Zambry then macam mana? Aisayman…
